New pokemon arrived. I was excited but my joy didn’t last long. I have played with this torch for a minute or so. I turned it off, put it on the table and went to get some coffee. When I came back, to my surprise the flashlight was on. Since then I can’t turn it off. Is the driver burnt out?

It’s an electrical short. Improperly constructed flashlight. It happens. Not going to spontaneously fix itself without trying to rebuild the light.
If you bought the light just recently, do a return, definitely.
For now, partially unscrew the battery tube until the LED turns off to prevent bad things. Or just take the battery out.
